Whether you resign or are terminated changes your UAE gratuity in some situations but not others — and the answer depends heavily on your contract type. This page breaks down exactly what changes, and what stays the same, for both resignation and termination.

The Short Answer

If you’re on a limited (fixed-term) contract — which covers almost everyone hired since February 2, 2022 — resignation and termination are treated identically. You receive the same 21/30-day formula either way, as long as you’ve completed one year of service and, if resigning, served your notice period.

If you’re on a legacy unlimited contract (started before February 2, 2022, not since renewed), resignation and termination are treated very differently, explained in full below.

Limited Contract: Resignation vs Termination

  • Resignation: Full 21/30-day formula, no reduction, provided notice was served and one year of service completed.
  • Termination (no misconduct): Full 21/30-day formula, identical to resignation.

Legacy Unlimited Contract: Resignation vs Termination

This is where the two paths genuinely diverge:

  • Resignation, under 1 year: No gratuity
  • Resignation, 1–3 years: One-third (â…“) of the 21-day rate per year
  • Resignation, 3–5 years: Two-thirds (â…”) of the 21-day rate per year
  • Resignation, 5+ years: Full rate
  • Termination (no misconduct), any tenure over 1 year: Full 21/30-day rate, no reduction

In other words, on a legacy unlimited contract, being terminated (without misconduct) is actually more favorable to your gratuity than resigning early — the reduction is specifically a resignation penalty, not something that applies to termination.

What Counts as “Resignation Without Notice”

Resigning without serving your contractual notice period can affect your entitlement separately from the contract-type rules above. Always serve your full notice period (typically 30–90 days depending on your contract) to avoid complications with your final settlement, regardless of which contract type you’re on.

What Counts as “Termination”

Termination initiated by your employer without cause (redundancy, restructuring, contract non-renewal) is treated the same as a normal termination for gratuity purposes. Termination for gross misconduct — fraud, serious safety violations, or similar — is a separate category that can result in denial of gratuity entirely under Article 120, regardless of your contract type.
